قانون مكافحة غسيل الأموال يشوبه القصور والكويت ليست محصنة

استأنفت الندوة الثانية التي يقيمها مكتب مكافحة عمليات غسيل الاموال في وزارة التجارة والصناعة تحت رعاية الوزير احمد باقر بعنوان «ساهم معنا في مكافحة غسيل الاموال» اعمالها في غرفة تجارة وصناعة الكويت امس، وعُقدت جلستا عمل الاولى تحدث فيها ممثلو جهات إنفاذ القانون والمهن القانونية، والثانية تحدث فيها ممثلو القطاع المالي والاقتصادي.
وتحدث مدير ادارة مكافحة الجرائم المالية في وزارة الداخلية العقيد فراج الزعبي عن دور وزارة الداخلية في مكافحة عمليات غسيل الاموال وقال انه منذ توقيع الاتفاقية الدولية لمكافحة المخدرات في العام 1989 والتي تضمنت مصادرة الاموال الناتجة عن تجارة المخدرات ساهمت وزارة الداخلية مع باقي اجهزة الدولة في اجراءات تعديل القانون الخاص بالمخدرات في حينه وفي العام 1995 صدر القانون الجديد بعد تعديله ليشمل مصادرة جميع الاموال الناجمة عن تجارة المخدرات.
واضاف انه في بداية التسعينات أنشأت الدول السبع الكبرى مجموعة العمل المالي الدولية بمساهمة 33 دولة ومنظمة وكانت دولة الكويت تحت مظلة تلك المنظمة من خلال مجلس التعاون الخليجي وتطورت العملية لتشمل جميع الاموال الناجمة عن الجرائم المالية، الى ان صدر قانون خاص بمكافحة غسيل الاموال من قبل وزارة المالية بمشاركة فاعلة من وزارة الداخلية وقطاعات حكومية اخرى، وبعد صدور هذا القانون أنشأت وزارة الداخلية ادارة لمكافحة جرائم المال واناطت بها مكافحة عمليات غسيل الاموال، مشيرا الى انه تم عمل دورات تدريبية لضباط بينها دورات بنكية اقامها بنك الكويت الوطني، كما تم عمل دورات تخصصية اخرى لضباط الادارة، مضيفا انه الى جانب ذلك تم إنشاء وحدة التحريات المالية التابعة لبنك الكويت المركزي وفيها عضو ممثل عن وزارة الداخلية ثم انشئت اللجنة الوطنية لمكافحة عمليات غسيل الاموال برئاسة البنك المركزي، وهناك ضباط اتصال من وزارة الداخلية على اتصال مع اتحاد المصارف الكويتية.
وقال العقيد الزعبي ردا على سؤال صحافي على هامش الندوة انه في العام 2008 تم الاشتباه بـ 25 حالة احيلت الى ادارة مكافحة جرائم المال، وتم اجراء التحريات اللازمة وتوصلنا الى 4 حالات مصدر الاموال فيها غير مشروع، احد هذه الحالات تبين فيها استيلاء على مال عام والحالات الاخرى اجراء اتصالات دولية من دون ترخيص وتزوير في محررات بنكية وتمت احالة هذه الحالات الى النيابة العامة.
وقدم استاذ القانون العام في كلية الحقوق في جامعة الكويت ابراهيم الحمود بحثا معمقا بعنوان «الاموال القذرة وكيفية غسيلها» شرح فيه مفهوم الاقتصاد الخفي او الاقتصاد الاسود كمدخل لغسيل الاموال، والآثار الاقتصادية لعملية غسيل الاموال (واثرها السلبي على اتجاهات الدخل القومي وعلى العملة الوطنية ونمط الانفاق).
ورأى ان ظاهرة غسيل الاموال باتت من الحقائق التي تعين التعامل معها بجدية سواء على الصعيد الداخلي او الخارجي، موضحا انه على الصعيد الداخلي يمكن للبنك المركزي ان يمارس رقابة فعالة وصارمة على عملية حركة الاموال من البنوك المحلية واليها من خلال إلزام البنوك بالفصح عن المعاملات المالية الداخلة اليها او الخارجة منها ما زادت على رقم معين او تكررت في اليوم نفسه او في تواريخ قريبة متى تعلقت بحساب واحد او حسابات بينها روابط من نوع ما، وربط كل ذلك بنظام معلومات مركزي ودون التضحية بقواعد سرية حسابات العملاء.
أما عضو جمعية المحامين الكويتية عضو جمعية الصحافيين المحامي محمد خريبط فقد تحدث عن قصور تشريعي في الكويت فيما يتعلق بمكافحة عمليات غسيل الاموال، مضيفا ان القانون الخاص بهذه الجريمة في الكويت رغم انه حديث إلا انه تبين ان هناك قصورا يشوب هذا القانون ويحتاج الى تعديل واعادة نظر خصوصا في المواد رقم (1 – 3 – 4 – 6 – و8) حتى يكون متكاملا، معربا عن اعتقاده بأن هذا القانون سيجري تعديله.
من جانبه، قال رئيس متابعة الالتزام في بنك بوبيان وليد العوضي في لقاء مع الصحافيين على هامش الندوة ان دور البنوك الكويتية مهم جدا في مكافحة عمليات غسيل الاموال، ودائما تكون البنوك اما اول خطوة او اول عملية كونها تتلقى اموالا نقدية اما من خلال تحويلات بين الحسابات الداخلية والخارجية او من خلال عمليات استثمارية وتوظيف الاموال.
ولفت العوضي الى ضرورة ان تكون البنوك فاهمة ماهية العملية التي تقوم بها ويجب ان تتوافق مع نشاط العميل الذي يتعامل معها، منوها بأنه في حالة وجود شكوك في صحة اي عملية او الهدف منها على البنك ابلاغ الجهات الاشرافية بالامر لتقوم بمهامها في التحري وبيان الامر.
وفيما إذا كان يرى ان القوانين المعمول بها حاليا في الكويت تشكل مظلة كافية لحماية الكويت من عمليات غسيل الاموال قال العوضي ان الكويت كانت سباقة في تبني المتطلبات الدولية خصوصا البنك المركزي الذي اصدر تعليماته الى البنوك قبل صدور القانون الخاص بمكافحة عمليات غسيل الاموال وقام ايضا بتطوير تلك التعليمات بعد صدور القانون.
واكد العوضي ردا على سؤال لـ «الراي» عن مدى تحصين الكويت من عمليات غسيل الاموال فقال ان الحماية المطلقة شيء غير موجود لكن الاجراءات الموجودة كافية لتوفير حماية للقطاع المصرفي والمالي في الكويت وهذه الاجراءات متطابقة مع المتطلبات الدولية في هذا الشأن.

نمر الصباح: مشروع قانون جديد
لغسيل الأموال إلى «الفتوى»

كشف مدير مكتب مكافحة غسيل الاموال في وزارة التجارة والصناعة الشيخ نمر فهد المالك الصباح خلال لقاء مع الصحافيين على هامش الندوة انه تم ارسال القانون الجديد المعدل الخاص بمكافحة عمليات غسيل الاموال الى الفتوى والتشريع، لان المنظمة الدولية تفرض علينا تطوير قوانين مكافحة عمليات غسيل الاموال، وكان القانون قبل التعديل يتحدث عن اشياء معينة عامة في حين القانون الجديد فيه تفصيل اكثر.
واشار ردا على سؤال الى ان وزارة التجارة من مهامها مراقبة القطاعات التي تتبع لاشرافها مثل المحلات التجارية ومحلات الذهب والمجوهرات وشركات التأمين، في حين يراقب البنك المركزي البنوك وشركات الصيرفة، لافتا الى ان صعوبات واجهت المكتب في عدم تجاوب التجار او تهاونهم في تطبيق هذا القانون لكن بالمثابرة وصلنا الى مرحلة عالية من بسط القوانين وتطبيقها، مشيرا الى انه تم اكتشاف بطاقات كريدت كارد مزورة عمد حاملوها الى شراء الذهب والمجوهرات من اماكن بعيدة مثل الفحيحيل وتم ضبطهم قبل سفرهم بساعتين.
وعن العقوبات التي تفرض على المخالفين قال ان العقوبات متدرجة وتبدأ من التنبيه اولا ثم اغلاق المحل مدة 15 يوما ثم الاغلاق لمدة شهر ثم سحب الترخيص، وقدر نسبة الوعي بين الناس بين 85 – 90 في المئة.

الهيئة العامة للمعلومات المدنية تتسلم دفعة من البطاقات الذكية

الكويت – 28 – 2 (كونا) — اعلن مدير عام الهيئة العامة للمعلومات المدنية مساعد العسعوسي ان الهيئة تسلمت اليوم دفعة من البطاقات الذكية والغلاف البلاستيكي الشفاف لها وبعض اجهزة للخدمة وبرامج للتشغيل.
وقال العسعوسي ان عملية التسليم تأتي تنفيذا لبنود العقد الذي وقعته الهيئة مع احدى الشركات المتخصصة لتنفيذ مشروع البطاقة الذكية ومن المنتظر قريبا أن تقوم الشركة بتوريد النسخة النهائية لنظام ادارة البطاقات الذكية اللازم لربط الطابعات والحاسب الرئيسي.
وكانت الشركة المعتمدة قامت يوم الثلاثاء الماضي بتسليم الهيئة جميع الطابعات المتفق عليها لتستخدم في طباعة البيانات بالبطاقة الذكية وتخزينها داخل الشريحة الألكترونية.
واشار العسعوسي الى ان الهيئة ستقوم بالاختبارات المكثفة على جميع مكونات المشروع ومن ثم الاعلان عن اجراءات الاصدار وخطة التوزيع لمشروع البطاقات. (النهاية) ز ز / ر ج كونا281810 جمت فبر 09

صرح الشيخ مشعل الجابر العبدالله الجابر الصباح وكيل وزارة الداخلية المساعد لشؤون تكنولوجيا المعلومات والاتصالات أن الإدارة العامة لنظم المعلومات وبالتنسيق مع شركات الهواتف المتنقلة ستقوم بإطلاق خدمة الرسائل القصيرة (SMS) حيث تمت دراسة الموضوع واخذ الموافقات بعد سنتين و8 شهور وهذه الخدمة سوف تخدم شرائح المجتمع المتعددة من الكويتيين والمقيمين الذين لهم علاقات في قواعد بيانات وزارة الداخلية حيث تم تحديد عدة خدمات الهدف منها إخطار المشترك بهذه الخدمات حتى لا تقع عليه المخالفات المادية عند نسيانه دفع التزاماته بما يخص المخالفات والمعاملات الخاصة بالوزارة

ويكون الأسلوب بإرسال رسالة تنبيه للمشترك على سبيل المثال إن كان المشترك لديه سيارة والمتبقي على انتهاء الدفتر فترة محدودة سيتم إخباره قبل هذه الفترة ليتدارك ذلك بتجديد المركبة وفي حالة عدم قيامه بالتجديد وتقع عليه الغرامة سيتم إرسال رسالة تنبيه إليه بأنه يوجد عليه غرامة وستكون باقي الخدمات بنفس الأسلوب.

وقال سنقوم كذلك بزيادة هذه الخدمات تباعا والإعلان عنها من خلال شركات الهواتف المتنقلة وهم (زين – الوطنية – فيفا) من خلال التعاقد المباشر مع هذه الشركات وتعتبر هذه الخدمة اختيارية للراغبين في الحصول عليها، وسيتم إطلاق الخدمة تباعا حسب جاهزية كل شركة من شركات الهواتف تبعا لاستعداداتهم الفنية.

وأعرب عن أمله أن تفيد هذه الخدمة شرائح المجتمع من الكويتيين والمقيمين وسيتم إطلاق خدمات جديدة قريبا إن شاء الله.
